TERMS AND CONDITIONS OF HIRE

Please read carefully.

 DEFINITIONS
  • ‘You’, ‘your’, ‘yours’ means the customer.
  • ‘We’, ‘us’, ‘our’ means Astrid Jensen.
  • ‘Hire equipment’ means all of the equipment that we provide for hire including the Candy Cart(s), glassware, plastic ware, crockery, tableware and decorative elements.
 
GENERAL
  • Our hire equipment remains our property. All consumable stock provided including confectionery, paper bags, paper cartons and balloons is yours to keep and no refunds will be issued for anything that you do not use. An inventory of all items will be supplied with your hire equipment.
  • We will do our absolute best to supply you with the equipment and consumables as ordered but reserve the right to supply you with suitable alternatives.
  • Prices quoted are usually for a hire period of 8 hours not including delivery and collection. Subsequent days will incur an additional charge.
 
PRICING
We reserve the right to alter our prices without notice. Any initial prices quoted by email or ‘phone may be subject to change. When we have received your booking form and you have paid your deposit the original price quoted to you will be honoured. We are not currently VAT registered so our prices do not contain VAT.

BOOKING
On receipt of your enquiry we will send you a booking form. Your date will be provisionally reserved for 7 days. On receipt of your completed booking form together with payment of your deposit the reservation of your date will be confirmed. We will also confirm the details of your booking to allow you to correct any errors.

DEPOSIT
A £50 non-refundable deposit is payable by bank transfer or via
Paypal on booking to reserve your date. This is deducted from your total balance.

OUTSTANDING BALANCE
The outstanding balance is payable by bank transfer or via Paypal 4 weeks prior to the hire date. We will issue a reminder by email or SMS. If the outstanding balance is not received in our account 4 weeks prior to the hire date, it will be presumed that the booking is cancelled and your reservation will be forfeited.

DAMAGE DEPOSIT
An additional £100 damage deposit is required, payable with your balance 4 weeks prior to your date. This will be refunded either:
in the event of a cancellation, by either party, within 30 days of written/email notification;
or;
within 30 days of the hire date subject to there being no damage, breakages or loss to the hire equipment provided by us.
  
DAMAGE, BREAKAGES AND LOSS
We expect our hire equipment to be returned to us in the same condition as it was supplied apart from possible surface marks that can be wiped clean and glassware, plastic ware, spoons, scoops and tongs that require cleaning. Damage to the hire equipment that exceeds normal use and would render your deposit non-refundable in whole or in part includes:
  • Deep scratches or dents that require to be filled and repainted;
  • Broken or missing components, e.g. wheel spokes, handles, decorative elements, canopy, side panels, etc. of the Candy Cart(s);
  • Broken or damaged glassware, plastic ware, spoons, scoops, tongs and tableware;
  • Lost or missing items.
Damaged hire equipment will be charged at its full replacement value including delivery to us. We will inform you in writing of any damages and an invoice will be issued for any charges in excess of the Damage Deposit payable within 30 days.

CANCELLATION
  • You may cancel your booking up to 4 weeks prior to your hire date. Cancellations must be in writing and acknowledged by us. Your £50 non-refundable deposit will be retained by us.
  • If you cancel the booking within 4 weeks of your hire date you will still be charged 100% of the total cost and there will be no refund of any payment made to us.
  • In the unlikely event that we cancel the booking you will be fully refunded including your initial £50 deposit.

AMENDMENTS TO BOOKINGS
Any amendments must be notified in writing or by email. We will do our best to accommodate changes though these may be subject to availability.  

DELIVERY, SET UP AND COLLECTION
We will deliver your hire equipment and set it up it at your venue in a location agreed with you and also, if applicable, your venue. 
Collection is normally the next day and will be arranged with you/your venue prior to your hire date. If we are unable to access your venue and cannot collect our hire equipment at the agreed date and time there will be a £50 charge for failed collection and additional daily hire charges at the rate of £200 per day. These charges will be invoiced to you and are payable within 30 days.

DELIVERY & COLLECTION CHARGES
There is NO additional charge for delivery and collection of the hire equipment to and from venues that are within a 10 mile radius of our premises at 739  South Street, G14 0BX. Any additional travel will incur an extra charge of 35p per mile. We will endeavour to deliver to the Highlands but regret that the Islands are beyond our reach.

PHOTOGRAPHY
Photographs of your assembled Candy Cart at your venue may be taken by us or a representative thereof and the images may be used on our website and social media for marketing purposes.

HEALTH AND SAFETY ALERTS - the health and safety of your guests is of paramount importance. Please note the following alerts:
Under no circumstances must the Candy Cart(s) supplied be moved by anyone other than us and our representatives.
The carts are NOT designed to be moved. They are carefully assembled in the location specified by you or your venue and fully checked prior to your event. We cannot be held responsible for any damage to property or persons if the cart is moved. All of our hire equipment must be used safely and for its intended purpose only. If any equipment becomes damaged you must not attempt to repair it and must not use it.
Allergens and Food Hygiene
If any of your guests have any allergies please notify us in advance. Customers must note that some of the edible products supplied may contain or have traces of allergens, e.g. nuts, or may have been made alongside other products containing allergens, e.g. nuts. We cannot be held responsible for any issues resulting from food allergies. A list of all ingredients and allergens will be attached to the cart for your information. You must not add your own sweets to those provided by us. In the context of Food Standards this is essential for traceability purposes.
Broken Glass
Glassware is fragile and must be used with caution. If any glassware provided with your Candy Cart(s) is broken during your event you must immediately ensure that the cart is ‘closed’ and that no further confectionery is consumed. This is to avoid injury or harm from any broken glass and/or the confectionery becoming contaminated with broken glass.
Child supervision
You must ensure that children using the cart(s) including selecting and eating confectionery, especially those aged under 5 years, are carefully supervised to avoid any risk of harm including choking. Glassware is fragile and must not be used by children. Children should not be allowed to sit or climb on the Candy Cart(s) due to the risk of falling or the cart breaking.
Strong Magnets​
Our unique decorative side panel is attached to the cart using very strong magnets. Please note that in close proximity - approx. 5cms or 2.5" - these can affect heart pacemakers*, mechanical watches, CRT monitors and televisions, credit cards, diskettes and other magnetically stored media. 

*
Heart pacemakers will be affected by the close proximity of a magnet. Magnets can set a pacemaker working in a way that is not suitable for the pacemaker user and may affect their health. 

LIABILITY
  • We accept no liability for any injuries or damage to any persons or property arising from any of our hire equipment or consumables. During the hire period you are solely responsible for the equipment under hire.
  • We accept no liability for any failure or delay to deliver our equipment due to circumstances beyond our control including weather conditions, traffic conditions, accidents and breakdowns.

ACCESSING OUR SITE
Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.
From time to time, we may restrict access to some parts of our site, or our entire site, to users who have registered with us.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.
When using our site, you must comply with the provisions of our acceptable use policy.
You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them.


VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

LINKING TO OUR SITE
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link from any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with the content standards set out in our acceptable use policy.
